The following terminology applies to these Terms and Conditions, Privacy
Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and
"Your" refers to you, the person accessing this website and accepting the
Company's terms and conditions. "French Collectables", "The Company",
"Ourselves", "We", "Us" and "I", refers to our Company. "Party", "Parties", or
"Us", refers to both the Client and ourselves, or either the Client or
ourselves. All terms refer to the offer, acceptance and consideration of
payment necessary to undertake the process of our assistance to the Client in
the most appropriate manner, whether by formal meetings of a fixed duration, or
any other means, for the express purpose of meeting the Client’s needs in
respect of provision of the Company’s stated services/products, in accordance
with and subject to, prevailing English Law. Any use of the above terminology
or other words in the singular, plural, capitalisation and/or he/she or they,
are taken as interchangeable and therefore as referring to same.
We are committed to protecting your privacy. Authorised employees within the
company on a need to know basis only use any information collected from
individual customers. We constantly review our systems and data to ensure the
best possible service to our customers. Parliament has created specific
offences for unauthorised actions against computer systems and data. We will
investigate any such actions with a view to prosecuting and/or taking civil
proceedings to recover damages against those responsible.
We confirm that any personal information which you provide to us is held in
accordance with the Data Protection Act 1998 (DPA) and that we follow the eight
enforceable data protection principles of good information handling, central to
the DPA. We use your information only for the following purposes:

When you create a shopping account whilst ordering online you will be given the
option to receive information from French Collectables by post, e-mail or
telephone, about products, promotions or special offers which we feel may be of
interest to you. If, in the event you do not wish to be contacted for such
purposes, ensure you tick the appropriate box as you go through the
registration process. You may unsubscribe from our contact list at any time by
replying to a promotional e-mail with the word "unsubscribe" in the subject
line, by e-mailing us, or by telephoning us on 020 8950 0930 between 0900 and
1700 Monday to Friday.
We will not release your personal information to any company for mailing or
marketing purposes.
While we will use reasonable endeavours to verify the accuracy of any
information we place on the website, we make no warranties, whether express or
implied to its accuracy.
The website is provided on an "as is" and "as available" basis without any
representation or endorsement made and we make no warranties of any kind,
whether express or implied, in relation to the website, or any transaction that
may be conducted on or through the website including but not limited to,
implied warranties of non-infringement, compatibility, security, accuracy,
conditions of completeness, or any implied warranty arising from course of
dealing or usage of trade.
We make no warranty that the website will meet your requirements or will be
uninterrupted, timely or error free, that defects will be corrected, or that
the site or the server that makes it available are free of viruses or bugs or
represents the full functionality, accuracy, reliability of the website. We
will not be responsible or liable to you for any loss or content or material
uploaded or transmitted through the website.
To the fullest extent permitted under applicable law, we disclaim any and all
warranties of any kind, whether express or implied, in relation to the
products.
This does not affect your statutory rights as a consumer, nor does it affect
your Contract Cancellation Rights.
Nothing in these Terms and Conditions shall exclude or limit our liability for
death or personal injury resulting from our negligence.
The laws of England and Wales govern these Terms and Conditions. By accessing
this website and buying our products you consent to these Terms and Conditions
and to the exclusive jurisdiction of the English courts in all disputes arising
out of such access.
If any part of the Terms and Conditions shall be deemed to be unlawful, void or
for any reason unenforceable, then that provision shall be deemed to be
severable from the Terms and Conditions and shall not affect the validity and
enforceability of any of the remaining provisions of the Terms and Conditions.
Each provision of the Terms and Conditions shall be construed as separately
applying and surviving even if for any reason one or other of those provisions
is held to be inapplicable or unenforceable in any circumstances.
Failure of the Company to enforce any of the provisions set out in these Terms
and Conditions and any Agreement, or failure to exercise any option to
terminate, shall not be construed as a waiver of such provisions and shall not
affect the validity of these Terms and Conditions or any Agreement or any part
thereof, or the right to enforce each and every provision. These Terms and
Conditions shall not be amended, modified, varied or supplemented except in
writing and signed by duly authorised representatives of the Company.
The Company reserves the right to change these conditions from time to time as
it sees fit and your continued use of the site will signify your acceptance of
any adjustment to these terms. If there are any changes to our privacy policy,
we will announce that these changes have been made on our home page and on
other key pages on our site, and these will be posted 30 days prior to these
changes taking place. You are therefore advised to re-read this statement on a
regular basis.
When you click the "buy" button, the item is added to your shopping cart. You
will be shown a review of your order and all prices before you submit your
personal and payment information. On-line payment can be by one of the
following; Mastercard, Visa, Switch, JCB, Visa Delta, Visa Electron, Visa
Purchasing and Solo.
Immediately after placing your order, you will receive an e-mail showing the
authorisation of your payment. You will then receive a further e-mail
summarising your order, the total price, your order number and our contact
details.
We take all possible precautions to prevent credit card fraud and will refuse
to accept orders where we consider that the transaction may be fraudulent or
the ID authorisation is refused by the credit/debit card processing company.
You can pay on line as detailed above or you can contact us and make a credit
or debit card payment over the telephone. If you wish to pay by cheque please
telephone to reserve the item you wish to purchase.
If you wish to purchase from this website and you live outside the UK please
contact us in order that we may calculate postage rates to your overseas
destination. Credit card payment from overseas buyers cannot be made online but
can be made over the telephone (00 44 (0)20 8950 0930) or via e-mail.
Information about you and your purchase is collected only after you have
transferred to the secure server and then only if and when you choose to
complete the purchase by clicking the "Make Payment" button. The transfer of
purchase details from us to the credit/debit card processing company are
encapsulated using encrypted and digitally-signed protocols. This uses a
combination of standard methods such as PGP, RSA and MD5 to ensure that the
information passed is secure and tamper-proof via 128 Bit SSL.
If you wish to change or cancel an order please contact us as soon as possible
on 020 8950 0930 anytime between 0900 and 1700 Monday to Friday. It would be
helpful if you could have the date of your order and order number to hand.
Orders are normally processed immediately so we may have already packaged your
order and made arrangements for it to be sent to you. If this is the case then
we cannot always stop the order from being sent, but we will do our best.
By law, when buying at a distance you have the right to withdraw from the
purchase of an item within seven working days from the day after the date the
item is delivered, known as the "cooling off period".
If you are withdrawing from your purchase within the seven working day cooling
off period, and there has been no error on our part or the item is not damaged
or defective, postage costs to return the goods to us will be non-refundable.
You should make sure that goods are securely packaged and you use a postal
service that will prove we have taken delivery as we cannot be responsible for
items lost prior to delivery to us. We will issue a full refund minus a 15%
administration and re-stocking charge. Your payment will be refunded within 30
days of the cancellation/return.
Occasionally, and in spite of our endeavours to package goods against all that
the postal and courier industry can throw at them, some goods do get damaged in
transit. If this happens contact us immediately and then please return the
goods to us securely packaged. We will issue a full refund and reimburse your
costs in returning the items to us. Your payment will be refunded within 30
days of receipt of the goods. We recommend you use a postal service that will
prove we have taken delivery as we cannot be responsible for items lost prior
to delivery to us.
In order to minimise cancellations and returns please do not hesitate to
contact us and we will be happy to answer any questions you may have and/or to
provide further photographs of the item(s) you wish to purchase.
If you have any issues you wish to discuss please contact us either by
telephone, e-mail or in writing. Details can be found in "Contact Us". If you
complain to us in writing, we promise to acknowledge it promptly and to tell
you how long it will take to resolve the complaint and to keep you informed
whilst we investigate.
All items on this website are offered for sale with free postage and packaging
(unless indicated in the item description) to residents of the United
Kingdom for delivery to mainland addresses in Great Britain and to addresses in
Northern Ireland.
If you are ordering from a British offshore island or from overseas, please
contact us direct in order that we may calculate the relevant postage and
packaging costs for your area.
Delivery is usually between seven and fourteen working days after payment. This
can be a bit longer for items going abroad.
All prices are inclusive of VAT (where applicable) at the current rates and are
correct at the time of entering the information online. We reserve the right to
alter our prices, should the VAT rate be altered.
Every care has been taken to ensure that descriptions and specifications are
correct at the time of online publication. All dimensions are approximate and
in metric measurements. Whist we make every effort to reproduce the colours of
the items accurately, slight variations may occur due to the manner of online
